Übersicht
The Substitute Building Materials Ordinance (EBV) regulates the material requirements for the disposal of mineral waste, the production of substitute building materials and their subsequent installation in technical structures (e.g. transport routes, paved areas, building foundations, car parks).
Mineral substitute building materials include recycled building materials from construction and demolition waste. They are produced in plants where the mineral materials are processed. The mineral substitute building materials produced in this way can be used by building contractors in technical structures in accordance with the provisions of the EBV, e.g. roads, paved areas, utility trenches, noise barriers and privacy screens. The use of mineral substitute building materials is not permitted outside of technical structures. Mineral waste must be examined for its usability in accordance with the provisions of the EBV, and the assessment is carried out according to the EBV's own material values. The use of such materials must be reported by the user to the lower waste management and soil protection authority.
Written notification is required if at least 250 m³ of dredged material of class F3 – BG-F3, soil material of class F3 – BM-F3, and recycled building material of class 3 – RC-3 are to be installed.
Furthermore, the planned use of mineral substitute building materials in designated water protection areas and medicinal spring protection areas must be notified.
For the use of mobile treatment plants:
- Notification in accordance with Section 5 EBV
For the use of a mineral substitute building material outside the regulations of the EBV:
- Application for an individual decision by the authorities in accordance with § 21 EBV
For the use of a mineral substitute building material in drinking water protection areas:
- EBV Annex 8 – Installation of substitute building materials within the meaning of EBV – Road/earthworks

Form to be used:
Nach Vorlage der erforderlichen Unterlagen zu den jeweiligen mineralischen Ersatzbaustoffen (MEB - z.B. Boden, Baggergut, RC, Gleisschotter, etc.) erfolgt die Entscheidung eines möglichen Einbaues dieser MEB durch die Untere Abfallwirtschaftsbehörde.
Nach erfolgtem Einbau der MEB sind die Entsorgungsbelege zu dem Bauvorhaben der Unteren Abfallwirtschaftsbehörde zeitnah vorzulegen.
